1) About us: 

We are passionate about toys and also a collector ourselves, so our hobby got out of hand and evolved into a professional activity. 
We sell both new and second-hand products (mainly vintage toys), intended for the consumer, in the following segments: Baby items (clothing, toys, stock, ...), Children's items (Toys, gadgets, clothing, accessories, school supplies, etc.) .), and Collection items (vintage toys, new collection items, gadgets, toys, merchandise, ...) 
You can always make a request with us about any products you are looking for, then we will look for the right product for you.

2) Applicability of the general terms and conditions 

Our terms and conditions apply to every offer on the Girls Boys & Toys website and to every consumer. 
 
We deliver worldwide, attention! Some countries may be refused due to certain legal restrictions. Certain products cannot be shipped to certain countries. If there is such a problem, we will contact the consumer as soon as possible. 
All buyers from countries where no shipping costs are indicated in the shopping basket can contact us in advance, and then we will see how we can best arrange the shipment and what it will cost.

To place an order, the consumer must be at least 18 years old, if misused, the order can be refused. 
 
Placing an order applies as express permission with our General and Special Terms and Conditions. 
 
When ordering online, you can always have a copy of our terms and conditions, whether or not included in the order confirmation email, or when delivered in paper version on request.

3) Offer, Order and Payment 

If an offer only has a limited validity or is subject to certain conditions, we will explicitly mention this on our website. 
 
The description of the products, both new and second-hand, is always carried out as accurately as possible, and we add truthful images to our description, if there are any errors in description or images, we are not obliged to deliver this properly and we can make the sale. Cancel. 
 
The order and confirmation is only final when we have actually received the payment, we are not responsible for the delay that this causes as a result of delivery or which leads to the non-delivery of a product. Orders without valid payment are not accepted and not processed. 
 
To conclude the purchase, the consumer adds the products to the shopping cart and passes on his delivery and billing address. The consumer can choose whether or not to create an account on our website or order as a guest. After that the correct method of delivery can be made and the consumer approves the general terms and conditions after acknowledging this, by confirming the order this payment obligation. After confirmation the purchase is final. 
 
There is a choice for direct payment via Bancontact, Paypal, Ideal, Sofort Banking, or prepayment via bank transfer. If you choose to pay in advance by bank transfer, we must have received the payment within 7 days, otherwise we will be forced to cancel the agreement. 
Payments outside the EU can only be made via Paypal, we are not responsible for delayed delivery if the payment is delayed by restrictions imposed by Paypal in the consumer's country. 
 

4) Prices 

All prices include VAT, taxes and services, but exclude shipping costs and any costs for the chosen payment method. The costs for shipping and payment methods are always displayed for the confirmation of the order. 
 
Should the consumer notice any error in price or costs, he may always inform us of this via eva@girlsboystoys.be

5) Conformity and warranty 

Girls Boys & Toys guarantees that all products conform to the order and meet the normal expectations that relate to the specifications of the product. 
 
We use the statutory warranty period of 2 years if a product should prove not to be in conformity with the order and to the extent that this is possible and reasonable, assuming the estimated lifetime of certain products. There is no guarantee for wear, damage and / or abnormal use caused by the consumer. 
 
To the extent that this is possible and reasonable, we will include the product for repair or replacement. If a repair or replacement is not possible, we will determine an intervention. 
 
No warranty applies to the defects described for second-hand goods. 
 
Some goods are covered by the warranty directly from the manufacturer, which means that you must contact the manufacturer directly in the event of a defect. (such as swimming pools, for example ...) 
  

6) Delivery and execution of orders 

All orders are delivered to the address specified by the customer, unless a choice is made for delivery at a collection point, this can be passed on through comments on the order. 
 
Products in stock are usually sent within 3 working days. Products that are not in stock are usually shipped within 7 days or as soon as possible after receipt from the supplier. 
 
Pre-order means that we do not have the products in our own stock, but that they are in stock at the supplier. After your order, we order the product from our supplier, after which we will send your order upon receipt. The delivery period normally never lasts longer than 7 days. 
 
The law stipulates that products must be delivered within 30 days, if this is not possible or if this period is exceeded, the consumer has the right to cancel the purchase. 
 
With regard to foreign orders, the delivery time may be longer. We always try to keep you informed of this and certainly also provide a tracking number for the shipment. 
 
We work with different shipping services for deliveries. Usually for domestic orders the shipping will be done with DHL, Bpost, but also DPD or Mondial Relay is a possibility on request. This also depends on the weight and size of the package. 
 
Shipping costs depend on the weight and size and the destination of the package. You can consult the costs in your shopping cart.

Pick up is possible with products that we have in our stock. Large and heavy items such as swimming pools, children's rooms and the like are delivered directly with pallet transport from our suppliers. Please note this shipment has a higher shipping cost. You can see this cost in your shopping basket before you pay. 
 

7) Right of withdrawal and return policy 

The buyer has the right, without stating any reason, within a period of 14 calendar days after delivery (= the day on which the buyer or a third party designated by the buyer, who is not the carrier, takes possession of the goods physically) seeing the purchase of his product. For this, the buyer must inform our company in writing within 14 calendar days. After receipt of the cancellation by the buyer, the company will confirm the validity. 
 
The buyer must hand over the products to Girls Boys & Toys without delay, but in any case no later than 3 calendar days after the day on which he communicated his decision to revoke the agreement to Girls Boys & Toys by appointment or by registered or traceable shipment to the following address send back:

In the event that the buyer exercises this right of cancellation, Girls Boys & Toys will refund the purchase price paid. The reimbursement is made using the same payment method as the one that the buyer used to make the payment. 
 
The costs associated with the shipment and the return shipment of the products are for the account of the buyer. 
  
If the returned products are damaged or have been reduced in value, Girls Boys & Toys reserves the right to hold the buyer liable and to claim compensation for any damage or depreciation due to the buyer. 
 
Only unused products that are also in the original unopened packaging and are taken back together with all accessories and accessories and the invoice or proof of purchase. 
 
Second-hand goods are tested and described as accurately as possible. These must also be returned in the sealed packaging and in the condition in which they were received, otherwise this right of withdrawal cannot be accepted.

Products for which the right of withdrawal does not apply: 
* Items that cannot be returned when the package is opened for health protection or hygiene reasons. (eg underwear, swimwear, diaper pants, toothbrushes, etc. hygienic products ...) 
* Used, dirty, damaged or incomplete items 
* Articles with the label removed 
* Personalized items or items that were specially ordered for the customer without Girls Boys & Toys having this standard in the range. 
* Collected products: the buyer has already had time to inspect the articles and to ask questions about the characteristics of the products. 
  
If the products were damaged during shipment or if they do not correspond with the products ordered, we expect this to be reported as quickly as possible and certainly within 3 days after delivery, and returned within 14 days. 
 
We cannot be held responsible for consequential damage due to late or non-delivery by the carrier, our liability is limited to the value of the products that can be shown not to have been received by the consumer. 
  

8) Force majeure 

In the event of force majeure, we are not obliged to meet our obligations, obligations can then be suspended until the period of force majeure or the agreement can then be definitively dissolved. 
  
By force majeure we mean that any circumstance that prevents us from fulfilling our obligations is beyond our control and control. This includes, among other things, strikes, fire, business disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or used communication systems and / or the unavailability of our website at any time, non-delivery or late delivery by suppliers or other third parties involved, ...

9) Intellectual Property 

Our website, logos, texts, photos, names and in general all our communications are protected by intellectual property rights. 
   
It is forbidden to make use of and / or make changes to the intellectual property rights. Copying or reproducing photos, logos, names, texts, etc ... without our prior and express written permission is not permitted. 
  

10) Complaints and disputes 

We do everything to satisfy all our customers for 100%. 
If complaints do arise about our products or services, the consumer can contact us via eva@girlsboystoys.be, we will try to deal with complaints within 7 days of receipt. 
  
All agreements that we conclude with our customers, regardless of their place of residence, are exclusively governed by Belgian law and in the event of disputes only the competent Belgian courts have jurisdiction. If, for reasons of international law, another law does apply, the interpretation of current general terms and conditions will first of all refer to the Belgian Market Practices and Consumer Protection Act.
